The President’s letter is being reviewed in the meeting
An important meeting under the chairmanship of Chief Election Commissioner Sikandar Sultan Raja regarding consultation with President Arif Alvi on the date of general elections is going on.
Members of the commission, secretary of the election commission and the legal team are participating in the meeting.
According to the sources, the President’s letter is being reviewed in the meeting.
The legal team gave a briefing regarding the elections in the light of the constitution and law.
It is the prerogative of the Election Commission to announce the election schedule under the Act, so it is also being considered that after the letter sent by the President to determine the date of the election, the Chief Election Commissioner will meet him. Or not.
The law is clear on this matter, President Arif Alvi cited the wrong provision of the Constitution for this purpose, the President has invited the Chief Election Commissioner citing Article 48 (5) of the Constitution.
According to the relevant part of Article 48 (5) of the Constitution, “When the President of the State dissolves the National Assembly, notwithstanding anything contained in clause (a), he shall fix a date for holding general elections to the Assembly which has been dissolved.” Not more than 90 days from the date of departure.”
In this case, the National Assembly was dissolved not by the President but on the advice of the Prime Minister after the completion of the term.
The President can only dissolve the Assembly by exercising the power under Article 58(2) when a no-confidence motion is passed against the Prime Minister and no member has a majority in the House.
It should be remembered that the Election Commission had written a letter to Maulana Fazlur Rehman for consultation yesterday, while the Commission will consult political parties regarding the schedule and date of the elections.
